Residential Awnings Warranty
Limited Warranty
This Awnings warranty is extended to the original Purchaser whose name appears on the sales order. Warranty is void once original purchaser transfers title of his or her home to another party.
1. Warranty
Classic Improvement Products (Classic) warrants, to the first Purchaser only, for our Awnings to be free from defective materials and workmanship, when properly maintained and under normal use and service.
This warranty does not cover installation costs, removal costs, service call cost, or shipping costs of any and all materials covered in the above limited warranties.
Classic does not directly warrant the fabrics, motors, electronics, or powder coat finish used for such screens. Rather, all fabrics, motors, electronics, and powder coat are warranted by the respective manufacturer and not directly by Classic.
Somfy Motors (Motorization Feature)
Somfy Motors come with a 5-year limited warranty. The Somfy Motor supplied is to be free from defects in material and workmanship under normal proper use for a period of 5 years commencing with the date of installation/activation of the product. If the motor fails within this 5-year period, the Somfy Motor manufacturer will repair or replace it free of charge. Warranty is void if the electrical motor is exposed to water, affected by acts of God, or abnormal conditions; abuse, fire, misuse, negligence, modification, corrosive environments, and/or vandalism. This warranty does not cover installation costs, removal costs, service call cost, or shipping costs of any and all materials covered in the above limited warranties.
Somfy Remote Control (Motorization Feature)
Somfy Remote Controls (radio transmitters and receivers) come with a 1-year limited warranty. The Somfy Remote Control supplied is to be free from defects in material and workmanship under normal proper use for a period of 1 year commencing with the date of installation/activation of the product. If the Remote Control fails within this 1-year period, the Somfy manufacturer will repair or replace it free of charge. Warranty is void if the Remote Control is exposed to water, affected by acts of God, or abnormal conditions, abuse, fire, misuse, negligence, modification, corrosive environments, and/or vandalism. This warranty does not cover installation costs, removal costs, service call cost, or shipping costs of any and all materials covered in the above limited warranties.
Screen Mesh & Fabric Warranty
The typical warranty for Screen Mesh or Fabric is 5-10 years depending on the manufacturer. Please contact our office in regards to the material you desire and we will gladly provide you with the warranty information. Warranty is void if the material is affected by acts of God, or abnormal conditions; abuse, fire, misuse, negligence, modification, corrosive environments, and/or vandalism. This warranty does not cover installation costs, removal costs, service call cost, or shipping costs of any and all materials covered in the above limited warranties.
Powder Coat Finish
Powder coating is warranted for 1 year against excessive peeling, corrosion, or rust. This is completely done out of convenience from Classic. Every powder coater in the industry only gives a 30-day warranty against peeling, corrosion, or rust because they do not know how it is treated. Once the powder coat is penetrated all warranties are void according to any powder coater which is why they only give 30 days, but our company has extended it to 1 year from installation. This warranty does not cover installation costs, removal costs, service call cost or shipping costs of any and all materials covered in the above limited warranties.
2. Purchaser’s Duties
The Purchaser shall give written notice to Classic, of any alleged failure of the Awning system within this limited warranty period, no later than 15 days after the Purchaser learns of such failure.
3. Disclaimer and Exclusion of Warranties
There is no express or implied warranty, representation, or condition of any kind (including without limitation warranty of merchantability or of fitness for use) except for the express warranty in paragraph 1 of this Limited Warranty, and no further warranty shall be implied by law.
4. Exclusion
This warranty and all of Classic’s obligations stated herein shall not apply to:
- any improper installations
- any change in color of parts that takes place over time
- any damage to fasteners from drill or screwdriver damage
- any faulty building construction or design
- any repairs or alterations made without the prior approval of Classic
- any awning damaged by misuse, abuse, vandalism, accident, or Act of God
- any exposure to corrosive environments (ex: salt water)
- any progressive deterioration (rust, etc.) of finishes and materials due to sun, rain, abrasion, heat, salt, and/or or cold
- any moderate fraying, curling, or bowing which is a natural characteristic of screen/fabric
- any moderate waffling or puckering of the screen/fabric near a fabric seam
- any installation of replacement awning parts
- any freight costs to ship product replacement to Classic
- any labor cost involved in the replacement
5. Limitation of Liability
It is understood and agreed that Classic’s liability, whether in contract, in tort, under any warranty, in negligence or otherwise, shall be limited to the undertaking set out above in paragraph 1 of this Limited Warranty, and under no circumstances shall Classic be held liable for indirect, punitive, special, incidental, or consequential damages or losses that anyone may suffer or incur in connection with this product in use.
6. Limitation of Actions
No action for breach of warranty shall be commenced by the Purchaser more than one year after the accrual of the alleged cause of action.
7. Professional Installation Required
Awnings must be professionally installed by a certified/qualified dealer and cannot be altered in any way by the end user.
8. Merger
This written warranty is the complete, final, and exclusive agreement of the parties with respect to the quality and performance of the Awning and to any and all warranties and representations related to it.
9. No Oral Modification or Waiver
No modification of this warranty, or waiver of its terms, shall be binding on either party unless approved in writing by both parties.
10. Governing Law
This warranty, and the rights and duties of the parties under it, shall be governed by the laws of the State of California.
